Privacy Policy

This Privacy Policy describes the types of personal information the DDN group of companies which includes DataDirect Networks, Inc. and its subsidiaries and affiliates, including, but not limited to, Tintri by DDN, Inc., Nexenta by DDN, Inc. and IntelliFlash by DDN, Inc. (collectively, “DDN”, “we,” “our,” or “us”) collect through our websites, including the website at www.ddn.com as well as all related websites, networks (the “Sites”), applications, products, and other services provided by us that link to this Privacy Policy (collectively, with the Sites, our “Solutions”). This Privacy Policy describes the personal information that we obtain in connection with our Solutions, how we use and disclose such personal information, the steps we take to protect such personal information, and how you can exercise your data protection rights.

Personal Information We Collect and How We Use It

“Personal information” means any information relating directly or indirectly to an identified or identifiable person and includes other similarly defined terms, such as “personal data,” as used in applicable privacy and data protection laws.

When you use our Solutions, we obtain personal information about you when you voluntarily provide it to us, when we collect it automatically through our solutions, from our vendors, and from other sources as described below. We use this personal information for the following purposes:

  • Account registration. We collect personal information for you to register an account with us, log in to your account, and use features of our Solutions, such as your name, contact details, company, geographic area, preferences, job title, and password. This personal information also allows us to manage your account.
  • Order and purchase. We collect personal information to fulfill your order features of our Solutions or the purchases you make through our Solutions, such as your name, contact details, job title, company, credit card or other billing information.
  • Customer communications and support. We collect personal information to respond to enquiries, support requests, or any other communications you submit through our Solutions, such as your name, contact details, and the content of your communications. We also use that personal information to communicate with you via technical notices, updates, security alerts, and support and administrative messages.
  • Promotions. We collect personal information to process and deliver entries and rewards in connection with promotions that we may offer from time to time, such as your name, contact details, job title, and company.
  • Operate and enhance our Solutions. We collect personal information to operate, maintain, enhance, and provide all features of our Solutions, such as your feedback or any other personal information related to your utilization of our Solutions. We also use that personal information to develop new products, services, features, and functionality.
  • Direct marketing. We collect personal information to send you direct marketing, in accordance with your marketing preferences. We use your name, contact details and account information to email you with marketing offers and resources, events, newsletters, whitepapers, and other company updates about DDN and other third parties.
  • Management and analysis of our Solutions. When you use our Solutions, we may collect certain information automatically from your device, including information like your IP address, operating system, device type, unique device identification numbers, browser-type, broad geographic location (by use of GPS or other geolocation features of your device) and other technical information. We also collect information about how you use our Solutions for purposes of facilitating your use of our Solutions, including securing, managing, measuring, improving, and/or supporting our Solutions as well as enabling us to develop and market additional products and services. We may also collect information about how your device has interacted with our Solutions including our Sites, including the pages accessed and links clicked. Some of this information may be collected using cookies, pixels, web beacons, and similar tracking technologies (collectively “Cookies”). We use these Cookies to understand and analyze the usage trends and preferences of our users; enhance and develop new products, services, features, and functionalities; administer our Solutions; track user’s movements around our Solutions; store preference information in our Solutions; serve targeted advertisements; and gather demographic information about our user community as a whole.   • Marketing. We may obtain personal information such as your contact details, job title, company, and interest from third parties, such as our partners and advertisers, and from other sources outside of our Solutions, including from certain offline sources such as trade shows or publicly available sources, to market our Solutions or services and products offered by third parties, in accordance with your marketing preferences.
  • Other purposes. We may use the personal information you voluntarily disclose to us for any other purposes disclosed to you and with your consent.

We process Personal Data, as permitted by applicable law, pursuant to the following legal bases:

  • Performance of a Contract or Steps to Enter into a Contract. For example, when we carry out a transaction or respond to your requests related to our Solutions.
  • Compliance with a Legal Obligation. For example, when we use Personal Data for audits and recordkeeping, respond to regulatory inquiries, or are involved in judicial or administrative proceedings.
  • With your Consent. For example, when consent is required by applicable law for direct marketing or targeted advertising.
  • As Necessary for Legitimate Interests. For example, in the case of business operations, commercial interests, Solutions operation, maintaining security and integrity, fraud prevention, and compliance with our contractual obligations.

If we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Disclosing Personal Information

We disclose personal information in the following circumstances:

  • Any personal information that you voluntarily choose to enter or otherwise input in a publicly accessible area of the Sites or any of our Solutions will be available to anyone who has access to that content, including other users.
  • We work with service providers, processors, and other vendors that provide website, application development, hosting, maintenance, marketing and advertising, sales enablement, and other services for us to help us offer our Solutions and operate our business.
  • We disclose personal information to our partners in connection with selling or distributing our Solutions or engaging in joint marketing activities, in accordance with your marketing preferences.
  • We disclose personal information if required to do so by any competent law enforcement body, regulatory, government agency, court or other third-party where we believe disclosure is appropriate or necessary to comply with applicable law or regulation, in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies.
  • We disclose personal information that we believe, in good faith, is appropriate or necessary to (i) take precautions against liability; (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity; (iii) investigate and defend ourselves against any third-party claims or allegations; (iv) protect the security or integrity of our Solutions and any facilities or equipment used to make our Solutions available; or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others.
  • We may disclose and otherwise transfer personal information to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, or in the event of an insolvency, bankruptcy, or receivership in which personal information is transferred to one or more third-parties as one of our business assets.
  • We may make certain deidentified, aggregated, automatically-collected, or otherwise anonymized information available to third parties for various purposes, including (i) compliance with various reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through our Solutions.

Cookies and Web Technologies

We and our vendors use cookies and other online tracking technologies (collectively “Cookies”) on our Solutions to:

  • collect and analyze information about your interactions with the Solution, including by collecting information about which pages you viewed or links you clicked and how you interacted with our content during your visit or over multiple visits;
  • store information to improve functionality;
  • help you access and navigate the Solutions more efficiently;
  • recognize your preferences and saved information;
  • customize your browsing experience, including by showing you information more likely to be relevant to you; and
  • deliver and customize advertisements and track campaign efficacy.

We and our vendors may collect personal information about your online activities over time and across different devices and websites when you visit the Solutions, and link information collected by Cookies to other information collected about you.

Our Solutions also use web analytics services, including Google Analytics, to evaluate your use of the Solutions by providing services about activity and internet usage to the website providers. We use information obtained through Google Analytics to implement Google advertising features such as remarketing with analytics, interest-based advertising, user segment analysis, and impression reporting.

We are not responsible for the effectiveness or accuracy of other parties’ notices or opt-out mechanisms.

Your Rights and Choices

Depending on your location and applicable data protection laws, you may have the following rights related to your personal information:

  • Request that we confirm whether we process your Personal Data.
  • Request access to or information about your Personal Data that we collect, use, and/or disclose.
  • Request that your Personal Data be corrected, updated, and/or completed if you become aware that any Personal Data we hold about you is incorrect, out of date, or incomplete.
  • Request a copy ofyour Personal Data, including in an electronic format, and that we transmit such Personal Data to another entity under circumstances required by applicable law.
  • Object to or restrict collection, use, disclosure, or other processing of your Personal Data under certain circumstances.
  • Withdraw your consent to process your Personal Data in circumstances where our collection, use, disclosure, or other processing is based on your consent; or request details about consequences for not consenting to a processing activity.
  • Request that we delete, destroy, anonymize, or block the processing of Personal Data that we have collected, used, disclosed, or otherwise processed about you.

While we will make reasonable efforts to accommodate your request, we also reserve the right to reject such access requests or to impose certain restrictions and requirements on such requests, if required or permitted by applicable law.

If you receive marketing communications from us, you may unsubscribe at any time by following the instructions contained within the email. Please be aware that if you opt out of receiving commercial email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten business days for us to process your request, and you may continue receiving promotional communications from us during that period.  Additionally, even after you opt out from receiving commercial messages from us, you may continue to receive transactional messages from us regarding our Solutions.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. We do not discriminate against any individual based on the exercise of their data protection rights.

Security

DDN implements physical, administrative, and technical safeguards designed to protect your personal information from unauthorized access, use, or disclosure. We contractually require that our suppliers protect such personal information from unauthorized access, use, and disclosure. Notwithstanding the measures DDN takes to protect your personal information, we do not guarantee the security of any personal information you provide to us or third parties.

Interactive Features

We may engage vendors to provide certain interactive features on our Solutions. Your use of these interactive features is voluntary, and we may retain the information that you submit through these features. For example, we may offer an interactive chat feature on our Solutions to answer questions and for other customer service purposes. When you participate in the interactive chat, either with a virtual or live agent, the contents of the chat may be captured and kept as a transcript. By using these features, you understand that our vendors may process the information obtained through the feature to provide the service on our behalf.

Linked Services

Our Solutions may contain features or links to websites and services provided by third parties. Any information you provide on third-party websites or services is provided directly to the operators of such services and is subject to those operators’ policies, even if accessed through our Solutions. We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which links or access are provided through our Solutions. We encourage you to learn about third parties’ privacy and security policies before providing them with information.

International Transfer of Personal Information and International Visitors

We may transfer and process your personal information in countries other than the country in which you are located in connection with storage and processing of personal information, fulfilling your requests, and operating and providing our Solutions. These countries may have data protection laws that are different from the laws of your country. Specifically, our Solutions are hosted in the United States and other countries where DDN and its subsidiaries are located or where DDN does business. We provide appropriate protections for cross-border transfers as required by applicable law for international data transfers, including entering into the European Commission’s standard contractual clauses for transfers originating from the European Economic Area.

Data Retention

We will only retain your personal information for as long as necessary to fulfill the purposes for which it was collected, or as necessary to:

  • comply with our business requirements such as manage your relationship with us or carry out our operations;
  • comply with any legal, accounting, or reporting obligations;
  • resolve disputes;
  • carry out a disclosed purpose that is reasonably compatible in the context in which the personal information was collected;
  • protect or defend our assets or rights;
  • efficiently run our business; and
  • enforce our agreements.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we collect or process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. Where personal information is used for more than one purpose, we will retain it until the purpose with the latest period expires.

California Privacy Notice

The following disclosures apply only to California residents covered under the California Consumer Privacy Act, as amended (“CCPA”).

Unless otherwise noted, the disclosures in this California Privacy Notice apply to our current practices, as well as our activities in the twelve (12) months preceding the last updated date of this Privacy Policy.

Personal Information We Collect

We collect the following categories of personal information under the CCPA, as described under the heading “Personal Information We Collect and How We Use It” above:

  • Identifiers, including name, postal address, unique personal identifier, online identifier, IP address, email address, and account name.
  • Personal Information Described in Cal. Civ. Code § 1798.80(e), including name, signature, address, telephone number, education and employment information, or employment history.
  • Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Internet or other electronic network activity information, including browsing history, search history, and information regarding interactions with an internet website application, or advertisement.
  • Geolocation data, including inferred from IP addresses.
  • Audio, Electronic, Visual, or Similar Information, including voicemails, photos, videos, and audio recordings.
  • Professional or employment-related information, including job title and company.
  • Inferences used to create a profile reflecting the consumer’s preferences, characteristics, behavior, attitudes, intelligence, abilities, and aptitudes.

Personal Information Sales and Sharing

Under the CCPA, a sale of personal information can refer to disclosures of personal information to third parties who may use the information for their own purposes, such as Cookie vendors. Additionally, sharing personal information refers to disclosing personal information to third parties for cross-context behavioral advertising. Accordingly, under the CCPA, we sell and share the following categories of personal information through our Solutions: identifiers, personal information described in Cal. Civ. Civ. Code § 1798.80(e), internet or other electronic network activity, commercial information, geolocation data, and inferences. We have sold and personal information to our Cookie vendors and adtech providers for cross-context behavioral advertising and other marketing and advertising services that we utilize through our Solutions. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age. California Privacy Rights

California residents have the following rights related to their personal information:

  • Know what personal information and access the personal information we have collected about you, including:
    • The categories of personal information that we process about you;
    • The categories of sources from which the personal information is collected;
    • Our business or commercial purposes for collecting, selling, or sharing personal information;
    • The categories of third parties to whom we disclose personal information; and
    • The specific pieces of personal information that we have collected about you.
  • Request that we delete personal information we collected from you, subject to certain exceptions.
  • Request that we correct personal information we maintain about you that you believe is inaccurate.
  • Opt out of sales and sharing of your personal information, and to request that we do not share your personal information for cross-context behavioral advertising. To opt out of sales and sharing, click the “Manage consent” tab in the footer of the Site.
  • Limit use and disclosure of sensitive personal information if it is used or disclosed in certain ways. We do not use or disclose sensitive personal information for purposes that would trigger this right under the CCPA.
